Township Ordinance

Listed below are summaries of some of the current Township Ordinances. Should you have any questions concerning an ordinance or wish to obtain the ordinance in its entirety please contact the Township Supervisors at (724) 966-5805 or the Police Department at (724) 966-8296.

#1-2000 Motor Vehicle Storage-(Section 3)

It shall be unlawful for any person, owner or lessee to maintain a motor vehicle nuisance upon the open private grounds of such person, owner, or lessee within those areas designated R-1, R-2, R-3, C-1, and V-1 of the Township. A motor vehicle nuisance shall include any motor vehicle which is unable to move under its own power and has any of the following physical defects: (A) broken windshields, mirrors or other glass with sharp edges (B) one or more flat or open tires or tubes which could permit varmin harborage (C) missing doors, windows, hood, trunk or other body parts which could permit animal harborage (D) Any body parts with sharp edges including holes resulting from rust (E) missing tires resulting in unsafe suspension of the motor vehicle (F) Upholstery which is torn or open which could permit animal or vermin harborage (G) broken headlamps or tail lamps with sharp edges (H) disassembled chassis parts apart from the motor vehicle stored in a disorderly fashion or loose in or on the vehicle (I) Protruding sharp objects from the chasis (J) broken vehicle frame suspended from the ground in an unstable manner (K) leaking or damaged oil pan or gas tank which could cause fire or explosion (L) exposed battery containing acid (M) inoperable locking mechanism on doors or trunk (N) open or damaged floor boards including trunk and firewall (O) damaged bumpers pulled away from the perimeter of the vehicle (P) broken grill with protruding edges (Q) loose or damaged metal trim and clips (R) broken communication equipment antennae (S) suspended or sunstable supports (T) such other defects which could threaten the health, safety and welfare of the citizens of the Township (U) any defect which would cause the vehicle to be ineligible for successful complettion of a PA safety inspection (V) the lack of a current PA inspection (W) lack of an existing registration. (Section 4) Any person, owner, or lessee who has one or more vehicle nuisances as defined in Section 3 may store such vehicle(s) in the Township only after obtaining a permit for either temporary or permanent storage. The nuisance(s) must be stored within a garage or other enclosed building, or outside within an opaque fence at least six feet high, which is locked at all times when unattended. (Section 5) All vehicle nuisance(s) stored outside shall be stored at least twenty-five feet from any building so as not to obstruct any firefighting equipment or emergency vehicles. Additionally, all such vehicles shall be stored at least twenty-five feet from any river, stream or other natural watercourse and twenty five feet from the nearest neighboring boundary line.Penalties: Fine of up to $300 and/or imprisonment for a term of not more than 90 days in addition to costs incurred by the Twp to remedy to correct condition plus 10%.

#1-2009 Livestock- (Section 4)

It shall be unlawful for any person to keep any domestic animals, except household pets, except that the keeper of every animal shall confine the same in an enclosure sufficient to prevent such animal from running at large, and such enclosure shall be of a size conducive to good sanitary practices and adequate, and sanitary drainage facilities shall be provided. Penalties: Fine of $300-$1,000 and/or imprisonment for up to 90 days.

#6-1999 Curfew- (Section 4)

It shall be unlawful for any minor to remain in or upon any public place or any establishment between the hours of 10 pm and 6 am any day of the year. The provisions of this section shall not apply to any minor accompanied by a PARENT or to any minor who is engaged in gainful lawful employment during the curfew hours. (Section 5) It shall be unlawful for any parent to knowingly permit any minor to remain in or upon any public place or establishment between the hours of 10 pm and 6 am any day of the year. MINOR is defined in this ordinance as any person under the age of 17. Penalties: Fine of $25-$300 or imprisonment for up to 90 days.

#5-2002 Air Pollution Control-(Section 4)

Within the Township Limits, no person shall (A) ignite or feed an open fire for the destruction of refuse or in the conduct of a salvage operation in any public or private place outside any building (B) Cause, suffer, allow or permit the maintenance of any open fire for the destruction of refuse, or in the conduct of a salvage operation on any property under his/her control outside of any building. (C) Ignite or feed an open fire for any other reason in any area designated as Village 1-and as defined by the Township Zoning Ordinance existing at the time. (Section 5 EXCEPTIONS) (A) Open fires may be set in performance of an official duty of any public officer (B) Open fires may be set after having secured a permit therefore from the local fire department or Code Enforcement Officer (D) Small well controlled fires for outdoor cooking in barbecue grills and the like (provided said fire is attended by a reasonable person until extinguished) may be set on any day between the hours of 7 am and 10 pm (E) Fires in a receptacle or in the open may be set each WEDNESDAY between the hours of 9 am and 6 pm without securing a permit as set forth in Section 5(B)(C)Penalties: Fine of up to $600 and imprisonment for up to 90 days.

#7-1999 Building and Property Address Identification- (Section 3)

The property owner of every residence, mobile home, apartment building, business, or other structure of any description whatsoever shall post and display the legally assigned number assigned to the said premises by the Township. (Section 4) The minimum size of the posted number upon any such structure shall be three inches in height unless the same shall be attached to a postal box, post or curbstone located within 10 feet of the right of way line of the street or road upon which the said structure is located, in which case the minimum height of such posting shall be 1 inch. (Section 5) The color of such posting shall be of such a contrasting nature to any background color to which it is attached as to be closely visible from the street or road upon which the structure is located. (Section 6) The said number shall be posted upon the structure or upon a post, curbstone, or postal box such that the same is clearly visible from the street or road upon which the said structure is located and shall be posted so that the said number cannot be obstructed by vegetation, trees, parked vehicles, or any other object whatsoever. Penalties: Fine up to $300 for each day of the violation and imprisonment for up to 90 days.

#3-1991 Keeping of animals making disturbing noises- (Section 2)

It shall be unlawful within the Township for any person(s) to own, possess, harbor, or control any animal or bird which makes any noise continuously and/or incessantly for a period of ten minutes or makes such noise intermittently for one-half hour or more to the disturbance of any person any time of the day or night regardless of whether the animal or bird is physically situated in or upon private property, said noise being a nuisance; provided, that at the time the animal or bird is making noise no person is trespassing or threatening to trespass upon private property in or upon which the animal or bird is situated nor is there any other legitimate cause which justifiably provoked the animal or bird. (Section 3) No person having possession, custody, or control of any animal shall knowingly or negligently permit any dog or other animal to commit any nuisance (defecation or urination) upon any public property or private property other than the property of the owner of such animal. (Section 4) Any person having possession, custody, or control of any dog or other animal which commits a nuisance (defecation or urination) in any of the places specified shall be required to immediately remove any feces from such surface. Penalties: Fine of up to $600 and imprisonment of up to 90 days.

#9-1999 Transient Merchant- (Section 4)

No person shall engage in soliciting or peddling in the Township without first having secured a license. (Section 5) Every person desiring to engage in the business or soliciting and/or peddling in the Township shall first make an application to the Township Code Enforcement Officer for a license. The application shall contain the following information: full name of the applicant, permanent address, name of employer, nature of goods, wares, or merchandise offered for sale, statement as to prior convictions of any crime, nature of crime and punishments imposed, type of vehicle used, upon request shall submit to fingerprinting and furnish a photograph, upon application for himself and one or more helpers, all information pertaining to the helpers. No license shall be transferable from one person to another. (Section 8) Licenses shall be carried by all persons while engaged in soliciting or peddling in the Township and upon request exhibit to the Code Enforcement Officer, Police Officer, Township Officials, and Citizens. No merchant shall enter or attempt to enter any dwelling house without invitation or permission of the owner or occupant and shall immediately leave upon request. No peddling or solicitations shall occur on Sundays or official holidays. No peddling or soliciting shall occur prior to 9:30 AM and shall cease at sunset or 6 pm whichever shall occur first. Penalties: Revocation of license and application fees. Fine of up to $300.
